1. General Information
These Terms of Service (“Terms”) govern the use of the online store Miyaōri, available at:

2. Definitions

Seller - Miyaori Joanna Augustyn.

Store - the online store operated at https://miyaori.com.

Customer - any natural or legal person using the Store or placing an order.

Consumer - a natural person acting for purposes outside their trade, business, or profession.

Entrepreneur with consumer rights - a natural person concluding a contract directly related to their business activity, where the contract does not have a professional character under Polish law.

Product - physical goods offered in the Store, including handmade scented candles and natural stone (travertine) vessels.

Sales Contract - a distance contract concluded between the Customer and the Seller through the Store.
3. Scope of Services

The Store enables Customers to:

browse Products,
-
place orders with or without account registration,
-
subscribe to the newsletter (optional),

contact the Seller electronically.

All Products offered are physical goods. The Store does not sell digital content or services.
4. Account and Orders
-
Creating an account is optional and free of charge.

Orders may be placed 24/7 via the Store.

An order is placed by:
-
adding Products to the cart,
-
completing the checkout form,
-
selecting delivery and payment methods,
-
accepting these Terms,
-
confirming the purchase via the final order button.

A Sales Contract is concluded once the Seller confirms acceptance of the order by email.

The Seller reserves the right to refuse or cancel an order in justified cases, including:

lack of payment within the required timeframe,
-
unavailability of Products,
-
obvious pricing or technical errors.

5. Prices and Payments

All prices displayed in the Store are gross prices (including VAT) and are expressed in Polish zloty (PLN).

Available payment methods include:

traditional bank transfer,
-
electronic payments (including BLIK and card payments),
-
other methods indicated during checkout.

Payment by bank transfer must be completed within 7 calendar days from the conclusion of the Sales Contract.

The Seller issues VAT invoices in electronic form only, sent to the email address provided by the Customer.
6. Delivery

Delivery is available only within Poland.

Delivery methods:

InPost Parcel Lockers,

InPost Courier.

Standard delivery cost: PLN 17,99, unless otherwise stated during checkout.

Orders are usually processed within 1-3 business days after payment confirmation.

The Seller is not responsible for delays caused by the carrier but will assist the Customer in resolving delivery issues.
7. Right of Withdrawal and Returns

Consumers and Entrepreneurs with consumer rights have the right to withdraw from the Sales Contract within 14 days, without giving any reason.

Detailed rules regarding withdrawals, returns, and refunds are described in the Returns & Refunds Policy, which forms an integral part of these Terms.
8. Complaints and Liability

The Seller is obliged to deliver Products that are in conformity with the contract.

Complaints may be submitted by email or in writing to the Seller’s address.

The Seller will respond to complaints within 14 days of receipt.

The Seller does not exclude statutory warranty rights for Consumers, Entrepreneurs with consumer rights, or Entrepreneurs.
9. Newsletter

The newsletter is an optional electronic service provided free of charge.

Subscription requires providing an email address and consent to receive marketing communications.

The Customer may unsubscribe at any time via the link in the newsletter or by contacting the Seller.
10. Intellectual Property

All content available in the Store, including texts, images, graphics, logos, and product descriptions, is protected by copyright and other intellectual property laws.

Any use of Store content without prior written consent of the Seller is prohibited.
11. Personal Data

The Seller is the controller of personal data processed in connection with the Store.

Personal data is processed in accordance with applicable laws and the Privacy Policy, available on the Store website.
12. Alternative Dispute Resolution (ADR)

Consumers may use out-of-court dispute resolution methods, including mediation and arbitration, in accordance with applicable regulations.

Information about consumer dispute resolution is available from consumer protection authorities and via the EU Online Dispute Resolution (ODR) platform.
13. Governing Law and Jurisdiction

These Terms and all Sales Contracts are governed by Polish law, with consumer protection provisions resulting from mandatory EU regulations.

For disputes with Customers who are not Consumers or Entrepreneurs with consumer rights, the court having jurisdiction over the Seller’s registered office shall be competent, unless mandatory law provides otherwise.
14. Final Provisions

The Seller reserves the right to amend these Terms for valid reasons, including changes in law, payment methods, or Store functionality.

Amendments do not affect orders placed before the changes take effect.

Matters not regulated herein are governed by applicable provisions of Polish law.
