MIYAŌRI ONLINE STORE TERMS AND CONDITIONS

§ 1. General Provisions
These Terms and Conditions (“Terms”) set out the rules for using the Miyaōri online store (“Store”), including rules for placing orders, concluding sales contracts, delivery, payments, withdrawal from contracts, and complaints.
The Store is operated by:

(hereinafter referred to as the “Seller”).
These Terms are made available free of charge on the Store’s website in a manner that allows their acquisition, reproduction, and storage.
To use the Store, the following are required: a device with Internet access, an up-to-date web browser, and an active email account.
The Customer is obliged to use the Store in compliance with applicable law and good practices, in particular not to provide unlawful content.
§ 2. Definitions
Customer - a natural person, legal person, or organizational unit with legal capacity that makes purchases in the Store or intends to do so.
Consumer - a natural person performing a legal act not directly related to their business or professional activity.
Entrepreneur - an entity making a purchase directly related to its business or professional activity.
Entrepreneur with consumer rights - a natural person concluding a contract directly related to their business activity, where the content of the contract indicates that it does not have a professional character for that person, in particular according to the scope of activity disclosed in the Polish business register (CEIDG).
Goods / Product - movable goods offered in the Store, in particular scented candles and vessels made of natural stone (travertine).
Sales Contract - a distance sales contract concluded between the Seller and the Customer via the Store.
Electronic Services - services provided electronically by the Seller, as referred to in § 3.
Order - a declaration of intent by the Customer aimed directly at concluding a Sales Contract, specifying in particular the Product, quantity, delivery method, and payment method.
§ 3. Electronic Services in the Store
The Seller provides the following Electronic Services:

Account (optional),

Order form (purchases with or without an account),

Newsletter,
-
Contact form (if available in the Store).
The agreement for the provision of Electronic Services is concluded for:

an indefinite period - for the Account and Newsletter,
-
a one-time fixed period - for the Order form and Contact form (for the duration of the given activity).
The Customer may resign from the Account or Newsletter at any time:

Account - by contacting the Seller via email: contact@miyaori.com (the Seller deletes the Account promptly, no later than within 14 days),

Newsletter - via the unsubscribe link in the message or by contacting the Seller by email.
Complaints regarding Electronic Services (excluding complaints regarding Goods) may be submitted:

The Seller shall respond to the complaint within 14 days.
§ 4. Product Information
Information about Products in the Store constitutes an invitation to conclude a Sales Contract within the meaning of the provisions of the Polish Civil Code.
Prices listed in the Store are gross prices (including VAT) and are expressed in Polish zloty (PLN).
The Seller makes every effort to ensure that Product descriptions and images are accurate; however, differences may occur due to individual screen settings and the natural characteristics of materials (e.g. unique veining and micro-imperfections of natural stone).
§ 5. Placing Orders and Conclusion of the Sales Contract
The Customer may place Orders via the Store 24 hours a day, 7 days a week.
An Order is placed by:

selecting a Product and adding it to the shopping cart,
-
completing the data necessary to process the Order,
-
selecting the delivery and payment method,
-
accepting these Terms,
-
clicking the button finalizing the purchase (e.g. “Buy and pay”, “Order and pay”, depending on the Store interface).
After placing the Order, the Customer receives an email confirming its submission.
A Sales Contract is concluded upon the Seller’s confirmation of acceptance of the Order for processing (via email).
The Seller may refuse to process an Order in justified cases, in particular in the event of non-payment within the required time, lack of product availability, or an obvious pricing error.
§ 6. Payments
The following payment methods are available in the Store:

traditional bank transfer,
-
electronic payment (including BLIK and card payments) via payment operators available in the Store,
-
other methods indicated during the Order process.
The payment deadline for traditional bank transfer is 7 calendar days from the date of conclusion of the Sales Contract, unless otherwise indicated in the description of the payment method.
Failure to make payment within the deadline may result in cancellation of the Order.
The Customer agrees to receive invoices electronically at the email address provided in the Order.
§ 7. Delivery
Delivery is available exclusively within Poland.
Available delivery methods:

InPost Parcel Lockers,
-
InPost Courier.
Delivery cost: PLN 19, unless otherwise indicated in the cart or on the delivery information page.
Order processing time is usually 1-3 business days, calculated from:
-
the date the payment is credited to the Seller’s account - in the case of traditional bank transfer,
-
payment confirmation - in the case of electronic payments.
The Seller is not responsible for delays resulting from reasons attributable to the carrier; however, the Seller will assist the Customer in the complaint or clarification process.
§ 8. Right of Withdrawal (Returns)
The Consumer and the Entrepreneur with consumer rights have the right to withdraw from the Sales Contract within 14 days without giving any reason.
The withdrawal period expires after 14 days from the day on which the Customer acquired possession of the Goods or on which a third party indicated by the Customer, other than the carrier, acquired possession of the Goods.
To exercise the right of withdrawal, the Customer must submit a clear statement (e.g. by email to contact@miyaori.com or by letter sent to the Seller’s address). The Customer may use the model withdrawal form provided in Appendix No. 1.
In the event of withdrawal, the Seller shall refund all payments received from the Customer, including delivery costs up to the amount of the cheapest standard delivery offered in the Store, no later than within 14 days from the date of receipt of the withdrawal statement.
The Seller may withhold the refund until the Goods are received back or until proof of return is provided, whichever occurs first.
The Customer is obliged to return the Goods without undue delay, no later than within 14 days from the date of withdrawal. Returned Goods should be sent to the following address:

The direct cost of returning the Goods is borne by the Customer.
The Customer is liable for any diminished value of the Goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the Goods.
§ 9. Complaints (Non-conformity of Goods / Statutory Warranty)
The Seller is obliged to deliver Goods in conformity with the Sales Contract.
Complaints regarding Goods may be submitted:

In the complaint, it is recommended to provide: name and surname, order number, description of the issue, date of discovery of the non-conformity, the Customer’s request, and contact details.
The Seller shall respond to complaints submitted by Consumers and Entrepreneurs with consumer rights within 14 days of receipt.
If returning the Goods is necessary to examine the complaint, the Seller will inform the Customer about the method and address for return.
The provisions of this section do not exclude or limit the rights of Consumers and Entrepreneurs with consumer rights under applicable law.
§ 10. Provisions Concerning Customers Who Are Entrepreneurs
The Seller also sells Goods to Entrepreneurs.
The Seller does not exclude statutory warranty rights with respect to Entrepreneurs.
In the event of a dispute with an Entrepreneur (who is not an Entrepreneur with consumer rights), the court having jurisdiction over the Seller’s registered office shall have jurisdiction, unless mandatory legal provisions provide otherwise.
§ 11. Newsletter
The Newsletter is an electronic service provided free of charge for an indefinite period.
Subscription to the Newsletter requires providing an email address and confirming the subscription, if the Store uses a double opt-in mechanism.
Unsubscribing from the Newsletter is possible at any time via the link in the message or by contacting the Seller by email.
§ 12. Personal Data and Cookies
The Seller is the controller of personal data.
The rules for the processing of personal data, legal bases, and the rights of data subjects are described in the Privacy Policy available in the Store.
The Store uses cookies in accordance with the information provided in the Privacy Policy (and, if applicable, a separate Cookie Policy).
§ 13. Out-of-Court Complaint and Claim Settlement (ADR / ODR)
The Consumer has the right to use out-of-court methods of handling complaints and pursuing claims, in particular with the participation of:

competent regional Inspectorates of the Trade Inspection,
-
permanent consumer arbitration courts,
-
municipal or district consumer ombudsmen.
The Consumer may also use the EU Online Dispute Resolution (ODR) platform.
§ 14. Final Provisions
The Seller may amend these Terms for valid reasons (e.g. changes in law, changes in payment or delivery methods, changes in Store functionality).
Sales Contracts concluded before the amendment of the Terms shall be governed by the version in force at the time the Order was placed.
In matters not regulated herein, the provisions of Polish law shall apply.
